Federal Anti-Arbitration Legislation Moves Forward

The House Judiciary Committee has approved the Fairness in Nursing Home Arbitration Act (H.R. 6126), which would prohibit nursing homes and assisted living communities from using pre-dispute arbitration clauses in their contracts.  

Arbitration is commonly used to resolve disputes outside of course and before they reach full litigation.  Traditionally consumer groups have opposed the use of arbitration and in the party-line vote last week the House Judiciary Committee sided with them. 

The House is currently on recess, so it is unknown when the proposed legislation will go for a vote on the House floor.
