We frequently receive questions from our Tuesday Tip subscribers regarding fingerprinting requirements for volunteers. Information on criminal clearance can be found in RCFE regulation 87355 and California Health and Safety Code Section 1569.17.
According to H&S Code 1569.17, a volunteer is EXEMPT from the criminal clearance (fingerprinting) requirement if ALL of the following apply:
- The volunteer is at the facility during normal waking hours.
The volunteer is directly supervised by the licensee or a facility employee with a criminal record clearance or exemption.
The volunteer spends no more than 16 hours per week at the facility.
The volunteer does not provide clients with assistance in dressing, grooming, bathing, or personal hygiene.
- The volunteer is not left alone with clients in care.
