New Form I-9

A new and revised Form I-9 has been released by the U.S. Citizenship and Immigration Services. The I-9 is used by employers to verify a new employee’s identity and to confirm eligibility for employment in the United States.

  1. I am just trying to be clear on this form as I work on it with my new staff hires: It is illegal for me to ask for their date of birth on their employment application but they must fill out a I-9 that asks for their date of birth on the I-9 form. Is this correct or does it violate some law?

  2. Hello Phil. Great question! The I-9 should be completed after they are hired, therefore you are not using that information to make the hiring decision. It states on the form that it should be completed “no later than the first day of employment” and “should never be completed before the employee has accepted a job offer”
